Arcadia Darlington – Activity Waiver & Participation Agreement
IMPORTANT NOTICE
By participating in any activity at Arcadia Darlington, including but not limited to Rage Rooms, Paint Splatter Rooms, Virtual Reality (VR) Experiences, Arcade Activities, and associated attractions, you confirm that you have read, understood, and agreed to the following terms.
These activities involve inherent risks, including risk of injury, damage to personal belongings, and physical exertion.
Nothing in this agreement excludes or limits liability where it would be unlawful to do so under UK law, including liability for death or personal injury caused by negligence.
1. ASSUMPTION OF RISK
Participants understand and accept that participation in Rage Rooms, Paint Splatter Rooms, VR Experiences, and related activities carries inherent risks including, but not limited to:
- Slips, trips, and falls
- Cuts, bruises, impacts, and minor injuries
- Damage caused by broken objects or debris
- Physical strain or exertion
- Motion sickness, dizziness, or disorientation during VR experiences
- Contact with paint, liquids, or materials used during activities
Participants voluntarily choose to take part entirely at their own risk.
2. FOLLOWING STAFF INSTRUCTIONS
All participants must follow all safety rules, written guidance, verbal instructions, safety briefings, and directions given by Arcadia Darlington staff at all times.
Failure to follow safety instructions, misuse of equipment, reckless behaviour, horseplay, intoxication, or deliberate disregard for rules may result in:
- Immediate removal from the premises
- Termination of the activity without refund
- Liability for any resulting injury, loss, or damage
Arcadia Darlington accepts no responsibility for injury, damage, or loss resulting from a participant’s failure to follow instructions or comply with safety requirements.
3. MEDICAL & HEALTH DECLARATION
Participants confirm that they:
- Are physically and mentally capable of participating
- Do not suffer from any medical condition that could make participation unsafe
- Will not participate under the influence of drugs or excessive alcohol
Participants are responsible for deciding whether they are fit to participate.
If pregnant, suffering from epilepsy, heart conditions, severe anxiety, injuries, or any condition that may be affected by physical activity, flashing lights, loud noise, stress, or VR experiences, participants should not take part unless they have sought appropriate medical advice.
4. UNDER 18 PARTICIPANTS
Participants under the age of 18 must:
- Have a waiver completed by a parent or legal guardian
- Comply with all age restrictions set by Arcadia Darlington
- Be supervised where required by staff or activity rules
Parents and guardians accept responsibility for supervising minors attending under their care.
5. PROTECTIVE EQUIPMENT
Where protective equipment is provided, participants must wear and use it correctly at all times.
Arcadia Darlington reserves the right to refuse participation to anyone failing to wear required safety equipment.
6. DAMAGE TO PROPERTY
Participants agree to treat all equipment, fixtures, gaming equipment, VR equipment, safety equipment, and venue property responsibly.
Participants are liable for the cost of repair or replacement where damage is caused by:
- Deliberate misuse
- Reckless behaviour
- Failure to follow instructions
- Use of activities outside permitted rules
- Intentional damage to restricted areas or equipment
This includes damage caused to VR headsets, controllers, arcade machines, walls, fixtures, barriers, doors, furniture, and safety equipment.
7. PERSONAL BELONGINGS
Participants bring personal belongings onto the premises at their own risk.
Arcadia Darlington accepts no responsibility for loss, theft, or damage to personal belongings unless caused by negligence for which liability cannot legally be excluded.
8. RIGHT TO REFUSE ENTRY OR PARTICIPATION
Arcadia Darlington reserves the right to refuse entry, remove participants, or terminate activities without refund where:
- Safety rules are not followed
- Behaviour is abusive, reckless, dangerous, or disruptive
- Participants appear intoxicated or under the influence of drugs
- Participants pose a risk to themselves, staff, or others
9. PHOTOGRAPHY & SOCIAL MEDIA
Arcadia Darlington may capture photographs or video footage for promotional or security purposes.
By entering the venue, participants consent to reasonable use of imagery unless they specifically notify staff otherwise.
10. LIABILITY
Participants acknowledge that participation is voluntary and undertaken at their own risk.
To the fullest extent permitted by law, Arcadia Darlington shall not be liable for:
- Injuries resulting from failure to follow instructions
- Injuries resulting from reckless or prohibited behaviour
- Damage caused by misuse of equipment
- Loss or damage to personal property
- Indirect or consequential losses
Nothing in this agreement excludes or limits liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot legally be excluded under UK law
11. ACCEPTANCE OF TERMS
By signing this waiver, booking activities, or entering activity areas, participants confirm that:
- They have read and understood this agreement
- They understand the risks involved
- They agree to follow all rules and staff instructions
- They accept responsibility for their own conduct
- They agree to be responsible for damage caused by misuse or reckless behaviour
